Terms of Business

  1. General: The Conditions of Business state the terms upon which all items are left in the studio and how work is done and advice given by the Conservator is based on the standard Terms prepared by the Institute of Paper Conservation (now ICON) for the use of its members. The Conservator’s work is governed by the ECCO Professional Guidelines 1993.
  2. In the absence of specific instructions from the Customer the extent of the work carried out by the Conservator in repair or preservation of any item shall be entirely within the discretion of the Conservator.
  3. Liability of the Conservator: Save in respect of liability for death or personal injury resulting from negligence, the liability of the Conservator in contract or tort for any defective work done or advice given in relation to any item or numbers of items or through the inadequate or negligent handling or storage of the item shall not exceed the fee chargeable by the Conservator for the work done or the advice given in relation to it.
  4. In no event shall the Conservator be liable to the Customer for incidental, consequential, indirect, special or punitive loss or damage of any kind, or for loss of revenue, loss of profit, loss of business or other financial loss arising out of or in connection with this Agreement or the Conservator’s work for the Customer.
  5. The Customer is responsible for insuring against all risk of loss or damage to the works of art or other items on which the Conservator works or has access to or in relation to which she/he advises.
  6. Time for Completion of Work: The Conservator will complete the work or give the advice within a reasonable time. Any dates given or periods of time quoted are estimates only and are not binding and may be subject to factors which were not apparent at the time this Agreement was made.
  7. Right to Sub-Contract: Unless previously agreed to the contrary between the Customer and Conservator the Conservator may sub-contract the work or arrange for the work to be carried out under her/his supervision.
  8. Invoice(s) will be issued when the work is completed and payment due date will form part of said invoice(s).
  9. Any items not paid for and collected by the invoice due date will be subject to a storage fee. The storage fee shall be £20+VAT per item, per week until the invoice has been paid and item(s) collected. For large or otherwise difficult to store items, the storage fee will be charged at a higher rate. In such cases, the Customer will be informed of the rate prior to its implementation.
  10. Any items not paid for within 6 months of invoice due date, and with no communication from the Customer, will be sold in order to recuperate costs incurred.
